Q. Is the certification of my work affiliation checked by the Board?
A. Yes, the Board checks salesperson work affiliation reported by your broker given the statutory requirement that a currently licensed salesperson must affiliate with a currently licensed broker for at least one year working at least 25 hours a week. Keep in mind that the work affiliation requirement for currently licensed salespersons will soon increase to a three-year affiliation requirement effective June 1, 2011.
The purpose of the work affiliation requirement is to provide salespeople
with the opportunity to gain actual work experience in the field of real
estate, but the Board continues to see problems in the reporting of
salesperson work affiliation by the affiliated broker. Specifically, the Board
has seen situations where affiliated brokers report times for salesperson
affiliation before the salesperson was licensed, or reporting affiliation time
periods when a salesperson’s license was expired. Moreover, many brokers fail to keep even the most basic of records as required by relevant Board regulations. Those records should at least note the name and license number of the affiliated salesperson, the days that they are working, and the number of hours that they have worked for those days.
Check with the Board to make sure that the affiliated salesperson is currently licensed and only report affiliation of those holding a current
license and working for at least 25 hours a week over the course of a year. Brokers can check on the license status of their affiliated salespeople at the Board’s web page at www.mass.gov/dpl/boards/re. Remember, a quick place to start is to simply look at the copy of the salesperson’s license, which should be posted at the office. This can often alert the broker to problems with the expiration of the license since the expiration date is printed on the license.
Brokers must also make sure that their license in the Commonwealth is
current for there have been situations where brokers reporting salesperson
affiliation are operating themselves with an expired license.
